New York Konvansiyonu Madde II(3)'ün Yorumlanması
New York Konvansiyonu madde II(3), bir İmzacı Devlet mahkemesinin,davanın tarafları arasında uyuşmazlığın konusuna ilişkingeçerli bir tahkim sözleşmesi varsa, işbu davanın taraflarını tahkimeyönlendireceğini öngörmektedir. Öte yandan, aynı hüküm, bu kuralınistisnalarını da düzenlemektedir. Buna göre, eğer bir tahkim sözleşmesi"hükümsüz, etkisiz veya ifa kabiliyetinden yoksun" ise, geçersiz sayılacaktır. Bu makalede, söz konusu istisnaların anlam ve kapsamı incelenmektedir.
Interpretation of Article II(3) of the New York Convention
Article II(3) of the New York Convention prescribes thatthe court of a Contracting State shall refer the parties of an actionto arbitration, if there is a valid arbitration agreement between theparties regarding the subject matter of the dispute. On the other hand,the same provision sets forth the exceptions of this rule. Accordingly,
an arbitration agreement would be deemed as invalid if it is "null and void, inoperative or incapable of being performed". This paper analyzes
the meaning and scope of the said exceptions.
